The following terms and conditions apply to Vodafone Giga5G Mobile Data Plans:

  • Usability:  Prepaid Vodafone Mobile Internet Users can access 5G services using the following 5G devices provided that their software updates are up-to-date. This list of devices will be updated as soon as device manufacturers release new 5G-ready software updates.

  • Auto-renewal: Vodafone Giga5G Mobile Data plans subscribed from *555# and *181# are set to auto-renew after their expiry period. To un-subscribe from the 5G data plans, dial *555# or *181#, select the plan you are subscribed to and select Option 2 to "Un-subscribe".
  • Data rollover: Remaining data will rollover upon auto-renewal or re-subscription of any rollover Data Plan before expiry. The remaining data will roll over to the furthest data plan expiry.
  • Exclusions: Rollover and Auto-renewal do not apply to Vodafone Mobile Data Gift Plans.
  • 5G requirements: To use Vodafone Prepaid 5G Mobile Internet Services, you must have a 5G-capable smartphone updated with a special 5G software update, be in a 5G coverage area, have a 5G-enabled data plan, and ensure that the network mode on your device is set to 5G. Note: Power Saving features may restrict your phone from accessing 5G in order to conserve battery power. Disable Power Saver Mode to access 5G. Customers using a 4G smartphone or a 5G smartphone that has not received a special 5G software update from their device manufacturer, or live outside a 5G coverage area can purchase and use Giga5G data plans at 3G/4G speeds.
    • Special 5G software update: Some 5G smartphones are not 5G-Ready yet as they need a special software update to connect to 5G. These updates are released by smartphone manufacturers. Manufacturers are working to release these updates as quickly as possible. After manufacturers have released a special 5G software update patch, customers will be notified by SMS to update their software.
    • Validity: Promotion is valid until further notice.


    4. Connect to the Network

    Use the normal wi-fi application on your computer or device to connect. Select the wi-fi network name from the list of available wi-fi networks. Click connect and enter the WPA2 password (secure wi-fi network key)

    The wi-fi network name (SSID) and secure wi-fi network key are written on the back of the device (see diagram below for location).

    2. Turn the device On

    Switch on the device by pressing and holding the power button. The device will go through its start-up sequence and will automatically connect to the Network. Check the display for connection status.

    18. Jurisdiction and Arbitration


    18.1 This Agreement is governed by the laws of the Fiji Islands.

    18.2 Any dispute arising out of or in connection with this Agreement shall be referred to arbitration.

    18.3 To the extent permissible by Law, the determination of the Arbitrator shall be final, conclusive and binding upon the parties hereto.

    17. General

    17.1 You must pay all our expenses in recovering any amounts you owe us including legal fees, collection fees and tracing fees.

    17.2 We will not be responsible to you for any indirect, consequential or special damages arising from any act or omission by us or any third party for whom we are responsible and whether arising in contract or statue.

    17.3 You must notify us immediately of any change of your details in your Registration form.

    17.4 You agree that your information, including your personal information, your conversations with our Customer Call Centre and your Transactions will be recorded and stored for record keeping purposes for 5 years from date of closure of your Account.

    17.5 All copyright, trademarks and other intellectual property rights used as part of the M-PAiSA Services or contained in our documents are owned by Vodafone or its licensors.  You agree that you acquire no rights thereto.

    16. Notices

    16.1 We are entitled to send information to you via SMS to the contact Mobile Phone number supplied on your application form.  These SMSs are for information purposes only.

    16.2 You should send any legal notice to us at our chosen address: M-PAiSA Service, Vodafone Fiji Limited, Private Mail Bag, Suva.

    15. Statements

     

    15.1 You may obtain a balance enquiry from your Mobile Equipment or query any transactions effected using your Mobile Equipment at the Customer Call Centre.

    15.2 To keep the cost of maintaining an M-PAiSA account as minimum as possible, Vodafone does not charge customers a fixed monthly account maintenance fee just to maintain an account. M-PAiSA charges are more ‘user pay” basis.  As such Vodafone does not provide printed account statements.  However, customers are able to view their last fifty (50) transactions on the M-PAISA app.

    However, should a customer require a statement of account, $2/page transaction fee applies on a user pay basis and statement is released only to the account holder on proper ID verification.

    14. Miscellaneous

    14.1 This Agreement (as from time to time may be amended) forms a legally binding agreement binding on you and your perpetual successors and assigns.

    14.2 This agreement may not be assigned by you to any other person or entity.

    14.3 No failure or delay by either of us in exercising any right or remedy hereunder shall operate as a waiver thereof, nor shall any single or partial exercise of any right or remedy prevent any further or other exercise thereof or the exercise of any other right or remedy.

    14.4 If any provision of these Conditions of Use shall be found by any duly appointed arbitrator, court or administrative body of competent jurisdiction to be invalid or unenforceable the invalidity or unenforceability of such provision shall not affect the other provisions herein and all provisions not so affected by such invalidity or unenforceability shall remain in full force and effect.

    13. Liability and Exclusions

    13.1 In the event that we are compelled to change or reassign Telecommunications numbering to meet regulatory requirements or for any other reason our liability will be limited to retaining your Account and where possible transferring your Account to a new MSISDN, failing which you will be paid out the Credit Balance standing in your Account in cash.

    13.2 To the maximum extent permissible by law we exclude warranties of all kinds, either express or implied.

    13.3 All Authorised M-PAiSA Agents are no more than independent outlets authorised by Vodafone to provide M-PAiSA Services and no agency  relationship exists between Vodafone and the Agents and we accordingly bear no responsibility or liability for any default  or negligence on the part of the Agents in providing the M-PAiSA Services.

    13.4 We shall not be liable for any loss which you suffer unless it is directly caused by our being negligent or deliberately acting wrongly.  If we do act negligently or wrongly, we shall only be liable for the amount of the loss that a normal Customer in your position would have suffered and not any loss which results from your particular circumstances; even if we know that your circumstances are unusual.

    12. Vodafone Responsibility

    12.1 Vodafone will hold all Payments received in respect of the Purchase of E-Value or transfers of E-Value (“Amount”) into your Account for your benefit and you shall be beneficially entitled to all those Amounts standing to the credit of your Account.  You agree that Vodafone may treat the records of the M-PAiSA System as conclusive evidence of the amount of E-Value at any time standing to the credit of your Account and Vodafone is not bound to make any independent investigation of your beneficial entitlement to the Amounts. You further acknowledge that, in relation to any payment  to you in respect of your entitlement to Amounts, we may act on instructions given by you using your PIN or instructions purported to be given by you using your PIN even if they are actually given by a third party.

    12.2 You acknowledge that Vodafone shall have no obligation to invest the Amounts other than by way of holding the same on your behalf.  You further acknowledge that, to the extent that any interest accrues on the Amounts, you shall have no beneficial entitlement to such interest and Vodafone shall be entitled to retain such interest to defray the costs and expenses of operating the M-PAiSA System and/or to pay the same to such charitable cause(s) as Vodafone may in its absolute discretion determine.

    11. Variations

    11.1 We reserve the right to vary at any time and without prior notice to you these Conditions of Use or the Tariffs.  Variations will be notified by way of  advertisement in a daily newspaper, SMS, or  through our Website and or by using any other suitable means PROVIDED THAT you shall be deemed to have been notified of any such variations regardless that the same may not have  actually come to your attention.

    11.2 By continuing to use the M-PAiSA Services you shall be deemed to have agreed to the modifications contemplated in clause 11.1 above.  If you do not accept any of the modifications then you must not continue to effect any Transactions otherwise you will be deemed to have accepted such modifications.
