Vodafone on the Commerce Commission Ruling

 Vodafone has always endeavored to work within the confines of law of the land.  When the Commerce Commission wrote to us last year for possible anti-competitive behavior, we cooperated fully by providing all relevant agreements and documents that the commission required for their investigations.

On completion of the investigation, the Commission was of the view that clauses in some of the agreements could possibly be exclusive in nature and therefore in breach of the Fair Trading Decree. Whilst, Vodafone has a legal right to pursue the matter in court, it has chosen to amicably resolve matter with the commission by terminating these agreements and replacing them with new ones.
 
Fair Trading in Fiji is still a very murky area given that the interpretation of the Fair Trading Decree is still not very clear. Fair Trading and anti-competitive behavior has also not been challenged in Fiji courts and therefore there is no local precedence to support an argument either way.  The only guide is the Fair Trading Decree itself which could be interpreted in different ways by different people.  Despite this, Vodafone has made a decision to work with the commission in the spirit of promoting fair competition in the market.
